We collect information through your use of the Smart Health Nepal mobile application (the "Application") and the services offered through the Application (the "Services"), this Privacy Policy discloses the practices of Smart Health Nepal and its predecessors, successors, licensors, beneficiaries, subsidiaries, agents, employees, representatives, and/or affiliates (collectively, "Smart Health Nepal" or "we"). Smart Health Nepal is dedicated to preserving your right to privacy and understanding that you should have your personal information protected and managed appropriately.

This Privacy Policy aims to provide you with information about different kinds of data that Smart Health Nepal collects from users through our application or services, as well as details about how that data is collected, used, and disclosed. It also explains how you can access, review, and modify the data that we use about you. As a result, please review over this policy carefully.

This privacy statement is only applicable to the services and application of Smart Health Nepal, and it takes effect as soon as you use the application. Please be aware that the independent doctor you are seeing may have different privacy standards or rules about how your medical information is used and disclosed. The use and sharing of your medical information in relation to the services that Doctor provided to you will thus be governed by the privacy rules and policies of that specific Doctor.

Terms referring to one gender must also refer to the other. Terms that signify a single number must also signify the plural and vice versa.

1.0 Collection of Personal Data

1.1 Information That You Give Us.

"Personal Data" refers to any information that can be used to identify an individual, such as their full name, identification card number, birth certificate number, passport number, nationality, address, phone number, fax number, bank information, credit card information, race, gender, date of birth, marital status, residency status, financial background, personal interests, email address, place of employment, industry in which you work, and any information you have provided to us in registration forms, application forms, or any other forms. It also includes sensitive personal data (as defined under the Personal Data Protection Act 2010) such as health.

1.1.1 The provision of your Personal Data is voluntary.

However, we might not be able to offer you our Services if you do not give us your personal data. We also won't be able to process it for the additional purposes and the purposes listed below. We really hope that giving us some personal information would be helpful to you.

1.1.2 The Personal Data that we collect varies depending upon how you use our Services.

When you register, you will be required to provide us with health-related data that a physician will want in order to decide whether or not to offer you medical services.

1.1.3 That Personal Data will be associated with your profile.

In order to help with treatment and handle other healthcare-related procedures, any medical information you submit through the application that briefly describes your symptoms will be forwarded to a doctor, if one is available and you will also be treated or consulted through online calls with the doctors and doctor will prescribe you the medicines. Smart Health Nepal will not use any medical information for any other purpose without your permission, which may be given through digital methods, with the exception of what is specified in this Privacy Policy.

1.1.4 Also, whenever you voluntarily disclose anyone’s personal information on publicly-viewable web pages, that information can be collected and used by others.

For example, you can get unwanted communications if you share your email address. We advise you to use caution and judgement when disclosing information through these interactive features, since we have no control over who sees your posting or what other users may do with the information you freely publish. An individual has full legal responsibility when they decide to upload material that will be made publicly available. According to any data protection regulations, we have no responsibility for information that you freely disclose on a website that is accessible to other people.

1.2 Other Information We Collect.

In addition to the personal data you provide to Smart Health Nepal directly, we may collect your personal data from a variety of sources such as:

  1. From application
  2. From publicly available sources such as directories
  3. From our social media pages and groups, if you follow, like or are a fan of such pages
  4. By using our website.

1.3 Medical Information.

In connecting you with a doctor to provide you with their medical services in connection with a visit, the Application may collect Personal Data from you and transmit it electronically. We will use administrative, physical, and technical safeguards to protect the security and privacy of information held in the Application. Our infrastructure is kept in a secured data center that protects from unauthorized access to the physical servers, backups and any element used to store and/or process personal data. Only authorized personnel can access the data center. Our systems and databases are backed up regularly to help protect the data in case of an uncontrollable catastrophe. The data-center(s) that stores our servers has policies and procedures in place designed to safeguard the equipment that our data is stored on. We regularly upgrade our system software to include the latest security features. Our servers are protected by a firewall system, which is designed to keep unwanted traffic or access out of our computer network. We also employ an intrusion prevention service (IPS) provided by a secured data center operated by a professional company. We also use security methods to determine the identity of each registered user, so that appropriate rights and restrictions can be enforced for that user. Reliable verification of user identity is called “authentication”. All communications between our Web server, your browser and our mobile apps is encrypted with SSL (Secure Sockets Layer) to guard against network eavesdroppers. Your password is internally encrypted in our system to prevent unauthorized access to the system. Validations are built throughout the application to capture the most reliable information.

1.4 Cookies.

To gather information, our application may make use of cookies and other technologies. Our websites store little data files called cookies on your computer's hard drive. We may use cookies to speed up the login process, let you create and save your settings, gather use data, measure the size and volume of our overall audience, and enhance our websites by identifying the most popular sections.

1.5 Tracking and/or Analytics Services.

We might make use of analytics and/or tracking services for mobile applications. While some mobile motions like tap, zoom, swipe, scroll, double-tap, and zoom may be recorded by these services, no personally identifiable information that you do not actively submit in the application is collected. Your browsing activities across mobile applications that don't use the same services aren't tracked by these services. We are making use of the data gathered by these services to better understand user behaviors and enhance website functionality.

1.6 Non-Health/Medical Information.

Smart Health Nepal application covers the collection, use, and protection of personal data, including usage metrics, location, cookies, and payment details. Regular updates to the policy underscore transparency and accountability, fostering trust among users regarding the app's data practices.

1.8 Mobile Device Information.

Information from your mobile device may be collected as part of your usage of the application. For example, the application could ask for permission to gather location information and/or to see any multimedia (such videos or photos) that are saved on your mobile device. If you do not want Smart Health Nepal to get your location data, please go to your mobile device's settings or answer appropriately when requested. Only when you actively choose to upload multimedia from your device to the application—that is, when you pick an image or video to be stored within the application will be gathered. Multimedia will not be shared with other Application users (with the exception of your profile photo, which will appear in your user profile).

2. Purposes of Processing: How We Use Your Information

Subject to this Smart Health Nepal Privacy Policy, the Terms of Service, and applicable terms and conditions of third-party applications, all data transmitted through the Application is owned by Smart Health Nepal. You grant Smart Health Nepal a perpetual, worldwide, royalty-free license to use such data (excluding medical information) as necessary to enable use of the Application and Services, to the extent that Smart Health Nepal is prevented from owning the data transmitted through the Application.

Smart Health Nepal may use and process your Personal Data for its business and activities which shall include, but not limited to, the following (“Purposes”):

2.2.1 Where you are a user of the Services provided by Smart Health Nepal (“User”):

  1. To carry out Smart Health Nepal's responsibilities under any contract you may have;
  2. To supply and deliver any services you have requested;
  3. To handle, control, or verify your application for a Smart Health Nepal subscription and to provide you with the subscriber benefits;
  4. To verify your requests, bookings, purchases, and payments for any goods or services you've requested;
  5. To handle your involvement in any events, activities, polls, promotions, research studies, or surveys;
  6. To understand and evaluate our sales as well as your requirements and preferences; and
  7. To handle product returns or exchanges.

2.2.2 Where you are an agent, vendor, supplier, partner, contractor or service provider:

  1. To motivate you to offer goods or services;
  2. To make it easier for Smart Health Nepal to conduct any necessary checks on you;
  3. To handle payments for any goods or services you have rendered;
  4. To speak with you.

2.2.3 General (applicable to all the parties referred to in Clauses 2.1.1 and 2.1.2 above):

  1. To respond to questions, comments and feedback from you;
  2. To communicate with you for any of the Purposes listed in this Privacy Policy;
  3. For internal administrative purposes, such as auditing, data analysis, database records;
  4. For purposes of detection, prevention and prosecution of crime;
  5. For Smart Health Nepal to comply with its obligations under the law;
  6. To enhance or develop features, products and services; and
  7. To personalize the content that you and others see on the Application.

Smart Health Nepal may also use and process your data for other purposes which include, but is not limited to, the following (“Additional Purposes”):

2.3 Revocation of Consent

You can cancel any such approval at any time, provided that Smart Health Nepal has not yet taken any action based on it, in writing. If you wish to cancel your permission that Smart Health Nepal has collected for the purposes listed below, please let us know by sending an email to the address shown below in the part of this privacy policy titled "How to contact us."

4. Sharing Your Information.

Your Non-Health/Medical Information may be transferred, accessed, or disclosed to third parties for the Purposes and Additional Purposes. Additionally, Smart Health Nepal may assign tasks to other businesses, persons, or service providers; as a result, these parties may have access to or disclosure of your Non-Health/Medical Information. We will not sell, trade, or disclose your Personal Data with third parties, unless specifically stated in this Privacy Policy, or if we notify you otherwise at the time of data collection and obtain your consent when necessary.

4.2 Doctors

We will share your Personal Data with the Doctor who responds to your request. The doctor may contact you through the online calls and prescribed you the medicines. The Doctor’s treatment of your information is subject to the Doctor and Doctor’s own policies and procedures. Any medical information that we collect from you will be kept private and secure, as required by law.

4.3 Pharmacy

Data security and user privacy protection are prioritized in the Smart Health Nepal pharmacy service. We collect information from the users and referred it to the doctors for the treatment that they want from the doctors through online calls. We provide the medicines that are prescribed by the doctors to them.

4.4 With Affiliates

We may share your Non-Health/Medical Information with affiliated companies and businesses. We will NOT share your medical or health information for any marketing purposes without your prior written consent.

4.4 With Service Providers

We may use other companies (such as information technology (IT) service providers) to perform services including, without limitation, facilitating some aspects of our application such as processing credit card transactions, developing our software and infrastructure, sending emails, and fulfilling purchase requests. These other companies may be supplied with or have access to your Non-Health/Medical Information, solely for the purpose of providing these services to you on our behalf.

4.5 With Business Partners

We may share your Health/Medical Information with the companies we partner with to provide you with those goods, services, and promotions when you use our application to make purchases or take advantage of promotions. You give us permission to share your information with a specific business partner when you accept their offer.

4.6 With other Service Providers

Occasionally, we may send anonymous information and data about Application users to other companies who work with us to offer customized services like advertising or data analysis. Medical or personal data are not included in this information exchange.

4.7 Special Circumstances

We also may disclose your Personal Data:

  1. As required by relevant law in response to a request or other investigative demand, a court order, or another request from law enforcement or a government agency.
  2. In situations where disclosure is required by law or permitted in the course of efforts to look into, stop, or take other action regarding suspected fraud, illegal activity, or other wrongdoing; to safeguard and defend the rights, property, or safety of our business, users, employees, or others; to comply with by applicable law or assist law enforcement; or to enforce the terms and conditions of our application or other agreements or policies.
  3. In connection with a business transaction, as needed or permitted by law, such as the sale of all or a portion of our company, a divestment, merger, consolidation, or asset sale, or in the unusual case of ending.

Special notice for applicants: If you choose to allow doctors to view your profile (or that of a minor or family member), all information you include in that profile (excluding personal contact information) may be viewed by doctors. nothing that you or anybody else would want to remain private should be entered on the profile. except from the personal contact information you provide through the application, doctors will not be able to contact you. After doctors get your information, we are not responsible for their use, retention, or privacy policies.

5. How to Access or Update Your Information.

Subject to any exceptions under the applicable laws, you may:

  1. Ask for access to and/or correction of your personal data;
  2. Want to restrict the use of your personal data for further purposes; and/or
  3. Send us an email using the address listed below in the "How to contact us" section of this Privacy Policy with any questions you may have about your Personal Data.

Subject to any applicable laws, Smart Health Nepal reserves the right to impose a fee for access of your Personal Data in the amounts as permitted therein.

In respect of your right to access and/or correct your Personal Data, Smart Health Nepal has the right to refuse your requests to access and/or make any correction to your Personal Data for the reasons permitted under the law, for example where the expenses of providing access to you is disproportionate to the risks to your or another person’s privacy.

If you do not wish for your Personal Data to be collected via cookies on our website, you may deactivate cookies by adjusting your internet browser settings to disable, block or deactivate cookies, by deleting your browsing history and clearing the cache from your internet browser.

6. How We Protect Your Information.

We take administrative, technological, and physical precautions that are commercially reasonable to protect the Personal Data and medical information under our control against theft, loss, and unauthorized use, disclosure, or alteration. We safeguard the information that is supplied to us both during transmission and after it is received by following to well recognised industry standards. However, there is no completely safe way to transmit data using mobile apps. As a result, even though we work hard to secure your personal information using methods that are acceptable to businesses, we are unable to ensure its complete security. In accordance with current legislation, you will be notified as soon as practically practicable in the unlikely case of a data breach. Moreover, we disclaim any liability for any security breach or action taken by any third party that obtains the information, including, but not limited to, any security failure or activity taken by a doctor.

7. Links to Third Party Sites.

Our application may contain links to websites or applications operated and maintained by third-parties, over which we have no control. Privacy policies for these third-party sites and applications may be different from our Privacy Policy. You access these third-party sites and applications at your own risk. You should always read the privacy policy of a linked site or applications before disclosing any personal information on such site and/or through such applications. Smart Health Nepal is not responsible for information you submit to third-parties.

8. Acknowledgement and Consent

By communicating with Smart Health Nepal, using the Application and our Services or by virtue of your engagement with Smart Health Nepal, you acknowledge that you have read and understood this Privacy Policy and agree and consent to the use, processing, and transfer of your Personal Data by Smart Health Nepal as described in this Privacy Policy.

From time to time we may modify, update, or amend the terms of this Privacy Policy by placing the updated Privacy Policy on our website. The effective date of such modifications, updates or amendments will be noted at the end of the Privacy Policy. You should therefore review it periodically so that you are up to date on our most current policies and practices. If we make material changes to our practices regarding the processing and/or use of your Personal Data, your Personal Data will continue to be governed by the version of the Privacy Policy to which such Personal Data was subject (prior to those changes), unless you have been provided notice of, and have not objected to, the changes. By continuing to communicate with Smart Health Nepal, by continuing to use our Services or by your continued engagement with Smart Health Nepal following the modifications, updates or amendments to this Privacy Policy, such actions shall signify your acceptance of such modifications, updates, or amendments.
